The claim of the petitioner in the instant Writ Petition was that though the claim for compassionate appointment on an earlier instance has been rejected on 15/11/2016, but subsequently he has made a fresh representation giving all material details in respect of dependency upon the deceased employee and that he was not dependent upon the persons who are in Government employment in the family and on this the counsel for the petitioner prays that the respondents may be directed to take a decision on the said representation.

The State counsel does not opposed the same.

Accordingly, let the respondent No.3 take a final decision on the representation of the petitioner which is pending consideration.

In addition, the petitioner would also be at liberty to make a fresh representation to the respondent No.1 in this regard ventilating his grievance and on such representation being made, the authorities may take a decision in accordance with the rules and regulations particularly the scheme for compassionate appointment applicable and decide the same at the earliest preferably within a period of 90 days from today. 5.
