1. The claim of the petitioner in the present writ petition is for grant of regular pay scale, which has been granted to similarly situated employees in the department.

2. Counsel for the petitioner submits that the petitioner was initially appointed on the post of Khalasi on daily wages as early as on 01.02.1986. In due course of time, the persons employed along with the petitioner had approached the High Court for grant of regular pay scale and at the behest of the High Court, an order has been passed, which has been complied with by the authorities concerned and regular pay scale has been granted to the similarly placed persons, who were employed along with the petitioner.

3. The petitioner has brought on record Annexure P/3, the orders passed by this Court in WPS No. 1861/2005, as also WPS No. 1914/2005 decided by the Division Bench of this Court.

4. Given the said facts, this Court does not intend to keep the writ petition pending further. The petitioner submits that his repeated representations made to the respondents in this regard are still pending consideration with the authorities.

5. Given the facts, let the petitioner make a fresh representation to the respondents No.2 & 3 within a period of 10 days from the date of receipt of certified copy of this order and thereafter the respondents shall consider the case of the petitioner verifying the facts as to whether the petitioner is similarly placed, if not identically placed like that of the other persons, of which reference shall be made in his representation and in case if it is found similar, then the petitioner would also be entitled for similar benefits.

6. Let this exercise be completed within a period of 90 days from the date of receipt of the representation by the petitioner.

7. With the aforesaid observations, the writ petition stands disposed off.
