1. The challenge in the present writ petition is to the order of transfer dated 19.11.2019 whereby the petitioner has been transferred from Korba to Gharghoda, District Raigarh.

2. Perusal of the record would show that the impugned order of transfer is not a transfer made on administrative exigency but it is an order issued on the promotion. The petitioner has been promoted from the post of Office

Assistant Grade-III to Office Assistant Grade-II. However though the order of transfer has been passed on 19.11.2019 till date the petitioner continues to discharge his duties at the present place of posting at Korba itself. The petitioner has made representation to the authorities concerned for change place of posting of the petitioner so far as order of promotion is concerned. The petitioner further submits that there are certain recommendations made by the higher authorities in the department for change of place of posting of the petitioner and retaining him at the same place. Further contention of the petitioner is that his wife also is a Government servant and is working as Assistant Teacher(L.B.) in the Government High School, Bhaisma District Korba.

3. Given the aforesaid factual matrix of the case, the writ petition at this juncture stands disposed of directing the respondent No.2 & 3 to take appropriate decision on the representation of the petitioner at the earliest preferably within a period of 45 days from the date of receipt of copy of this order.
