The relief sought for by the petitioner through the present writ petition is for an appropriate direction to the respondents to consider his application for grant of permanent caste certificate at the earliest.

Learned State Counsel at the outset submits that, let the petitioner move an appropriate application in accordance with the Chhattisgarh Scheduled Castes, Scheduled Tribes & Other Backward Classes (Regulation of Social Status Certification) Act, 2013 (hereinafter referred to as the "Act of 2013") for grant of caste certificate to respondent no.3 who shall consider and decide the same on its own merits in accordance with procedures laid down in the said Act of 2013 and the rules framed therein.

Accordingly, the writ petition is disposed of, directing the petitioner to move before respondent no.3 by way of a fresh application in the pending case of his before respondent no.3 and the petitioner is also directed to complete all the formalities including submission of all the documents/records/certificates to establish his caste status and if required he may also submit 'inability certificate' in accordance with the said Act of 2013.

Respondent no.3 in turn is further directed to scrutinize the case of the petitioner in accordance with the procedures prescribed under the law and pass appropriate order at the earliest, preferably within a period of four months from the date the petitioner completes all his formalities. 5.
