1. Heard.

2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.310/2020, registered at Police Station Sarsiwa, District - Balodabazar Bhatapara C.G., for the offence punishable under Section 20(B) of the NDPS Act.

3. The concerned Police received a secret information that one motorcycle parked in front of house of Damrudhar Das Vaishnav is carrying cannabis (ganja). When the

MCRC No. 9407 of 2020 unnumbered motorcycle was searched it was found to be carrying 6 kgs of cannabis (ganja) and the present applicant and co-accused Narsingh Das were inside the house of Damrudhar. When enquired about motorcycle, Damrudhar informed the Police that the same belongs to the guests who have come to visit his house.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the fact that co-accused Narsingh Das Vaishnav has already been released on regular bail by this Court in MCRC No.8151/2020 vide order dated 10.2.2021 and also for the fact that applicant is in jail since 28.9.2020; charge-sheet has already been filed, I am inclined to release the present applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
