1. The challenge in the present writ petition is to the order of transfer dated 21.8.2019 Annexure P-1 whereby the petitioner has been

transferred from Govt. Girls Higher Secondary School, Manendragarh, District Koriya to Govt. Higher Secondary School, Pashupatipur, Wadrafnagar, District Balrampur.

2. The contention of the petitioner is that the respondents themselves have issued an order not to relieve the teachers on whose relieving student and teacher ratio in a school gets adversely affected. Further contention of the petitioner is that the petitioner has come to the present place of posting only on 23.05.2017 and within a short span of time the petitioner is being transferred to a different place.

3. Given the aforesaid facts, particularly taking into consideration the circular of the State Govt. and the order passed by the District Education Officer, Baikunthpur dated 28.08.2019, let the petitioner within a period of 10 days from the date of receipt of certified copy of this order make an appropriate representation to the respondents who in turn shall consider and decide the same within a period of 45 days from the date of receipt of representation.

4. Till the representation is decided, the effect and operation of the impugned order so far as the petitioner is concerned shall remain stayed.
