1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 94/2017 registered at Police Station Tilda Nevra, Distt. Raipur (C.G) for the offences punishable u/ss 363, 366, 376 & 342 of IPC and section 4 of the Protection of Children from Sexual Offences Act, 2012.

2. A perusal of the record would show that statements of as many as 7 witnesses have been recorded. Therefore, at this stage, it would not be proper for this Court to give a finding and express any opinion on the merits of the case while deciding this bail application as it would affect the trial. It is for the trial Court to arrive at a finding and adjudicate the case after assessing the evidence as a whole. Accordingly, this bail application is rejected.
