Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 26-101. This is third bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.

2. The applicant has been arrested in connection with Crime No. 8/2017 registered in police station Somni, Distt. Rajnandgaon (CG) for offence punishable under Section 365, 366, 376, 506, 34, IPC.

3. Perused the case diary.

4. Counsel for the applicant argued that the applicant is innocent and falsely implicated hence he may be released on bail. To contend that the prosecutrix was a consenting party, he drew my attention on the deposition of P.W. 5 Gajendra Kumar Gupta, P.W.6 Neelesh Deshmukh, P.W. 7 Smt. Geeta Gupta, P.W. 8 Indrabhan Dagarjee and photocopy of CL application of the prosecutrix.

5. On the other hand, the State Counsel opposed the bail application.

6. What would be the affect of the aforesaid statements and the document may be considered by the trial Court at the time of disposal of the trial.

7. Counsel for the applicant has not been able to show any new ground after rejection of earlier bail applications which entitles the applicant to be enlarged on bail.

8. Consequently, the MCRC is dismissed.
