This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.195/2018 registered at Police Station Khairagarh for the offence punishable under Sections 4, 6, 10 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004. 2.

The first bail application of the applicant was rejected on merits after considering prima facie of case by the order of this Court dated 21.08.2018 passed in M.Cr.C. No.5374 of 2018. 3.

Case of the prosecution in brief is that on 26.06.2018 applicant was taking away 122 cattle for slaughtering at Nagpur. 4.

Counsel for the applicant submitted that the applicant has already acquitted in two cases, out of three cases registered against him hence he may be released on bail.

On the other hand, counsel for the State opposed the bail application.

Looking to this facts that in this case, three others criminal cases have already been registered against the applicant and there is no such

change in the circumstances of the case by which the applicant is entitled to get the benefits of Section 439 of CrPC. Consequently, the second bail application of the applicant is rejected. Sd/- (Sharad Kumar Gupta) JUDGE L/-
