The applicant has preferred this application under Section 439 of the Cr.PC. for grant of bail as he is arrested in connection with Crime No.416/2015 registered in Police Station Dharsiwa, District Raipur (C.G.) for offence punishable under Sections 376 (2) (>) of IPC and Section 5 (M+)/Section 6 of the Protection of Children from Sexual Offences Act and Section 3/181 of the Motor Vehicles Act.

As per the prosecution case, on 21.11.2015, in between 7 am to 12 noon, the applicant took the victim aged about 5 years on his auto to a lonely place and committed forceful sexual intercourse with her and as such, he committed the offence as afore-stated.

Learned counsel for the applicant submits that the medical report do not support happening of the incident and the applicant has been falsely implicated in the case, therefore, learned counsel for the applicant submits that the applicant may be enlarged on bail. 4.

Learned counsel for the State opposes the bail application. 5.

Perused the case diary and statement. Having considered the facts and circumstances of the case and taking into the statements of the girl aged about four and half years and her mother, this Court is not inclined to release the applicant on bail. 6.
