On due consideration, delay of 6 days in filing the CRMP is condoned. Accordingly, IA No.1/2020 is allowed.

The Trial Court has acquitted the accused of the charges under Section 376 of IPC.

The prosecutrix, aged about 29 years, admits that after an affair, she and the accused had planned to marry, therefore, she entered into consensual sexual relation out of her own free will. She clearly admits that they used to meet each other as and when he or she desired. 4.
Considering the statement of the prosecutrix, no case for grant of leave to appeal is made out.

Accordingly, the CRMP is dismissed.
