The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.104/2016 registered in Police Station Bhatgaon, District Surajpur (C.G.) for offence punishable under sections 306 read with section 34 of Indian Penal Code. 2.

As per the prosecution case, one Idni Bi @ Indrani Ansari committed suicide by setting herself ablaze. She was first wife of applicant No.1 Rahimuddin and applicant No.2 Sukhmaniyan Gond was second wife of applicant No.1. It is alleged that both the applicants i.e. husband and second wife used to torture the deceased who was the first wife. Consequently, she was abetted to commit suicide. 3.

Learned counsel for the applicants submits that the applicants have been falsely implicated and they have not abetted commission of crime, charge sheet has been filed, no further investigation is necessary, therefore the applicants may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Perused the statement of Saifuddin, Ibrahim and Kismatiya. Considering the facts and circumstances of the case, this court is inclined to release the applicants on bail.

Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
