This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.158/2015 registered at Police Station Balco, Tahsil & District Korba (C.G.) for the offence punishable under Section 302, 201, 404 read with Section 34 of Indian Penal Code. The earlier bail application was dismissed on merit on 06.01.2016 in M.Cr.C. No.7474 of 2015. 2.

Learned counsel for the applicant submits that out of 17 witnesses 16 witnesses have already been examined and only one I.O. is remained to be examined and the Court is vacant, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the fact that out of 17 witnesses, 16 witnesses have already been examined and there is no change of circumstances appears, I am not inclined to release the applicant on bail. 5.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
