Petitioners are legal heirs of Late Chandra Shekhar Kurre, who was serving as Constable with the Chhattisgarh Police at the time of his death in the naxal ambush on 06.02.2006. The amount lying in the service account of the deceased constable was deposited in form of term deposit receipt with the State Bank of India, Jashpur vide Annexures-P-1 to P-3 for the reason that the petitioner Nos.2 to 4 were minor.

Learned counsel for the petitioner would submit that the petitioner No.1 being the widow of Late Chandra Shekhar Kurre is responsible for taking care of the upbringing including education of the petitioner Nos.2 to 4, however, the same has become difficult for want of funds, therefore, soon after the date of maturity of the TDR, the petitioner No.1 approached the respondent No.3 for withdrawal of the amount which has been denied by the said respondent for want of instruction from the Head Office.

Considering the entire facts situation of the case, the writ petition is disposed of with direction that in the event, the petitioner No.1 moves representation before the respondent No.3 seeking encashment of TDR which has matured on 12.03.2018, the Manager of the respondent No.3 Branch shall pass a reasoned order within 4 weeks from the date of submission of representation.
