Hon'ble Shri Justice P. Sam Koshy Order on Board 05.09.2019

1. Challenge in the present Writ Petition is to the order of suspension dated 20.06.2019.

2. The contention of the petitioner is that, the grounds alleged in the order of suspension, per se, would not make out a case of misconduct for placing the petitioner under suspension.

3. During the course of hearing it has been informed that the petitioner immediately on the issuance of the impugned order had preferred an appeal on 30.07.2019 before the Chairman of the Respondent No.2Corporation, but the appeal till date has not been decided by the appellate authority.

4. Given the facts that the appeal of the petitioner against the impugned order dated 20.06.2019 is already pending before the respondent No.2, they are directed to ensure that the appeal of the petitioner is decided by

the appellate authority/appellate forum within a period of 30 days from the date of receipt of copy of this order. It is also expected that the appellate authority/appellate forum while deciding the appeal of the petitioner shall consider the grounds raised in the appeal and shall decide the same by a speaking order.
