1. The challenge in the present writ petition is to the order of transfer dated 12.07.2019 Annexure P-1 whereby the petitioner has been transferred from Sub Health Center Murmunda, Block Dongargarh, District Rajnandgaon to Sub Health Centre Bodegaon, Block Manpur, district Rajnandgaon.

2. The contention of the petitioner is that the petitioner and her

husband are working in the same department and therefore, as per the transfer policy, they should have been accommodated at the same place.

3. Given the aforesaid fact, let the petitioner make a detailed representation to the respondent no.2 within a period of 10 days from the date of receipt of certified copy of this order and the respondent no.2 in turn shall consider the grievance of the petitioner in accordance with the transfer policy and try to accommodate the petitioner as far as possible at the place where her husband is working or a nearby place.

4. It has been informed that the husband of the petitioner was earlier working in Durg, on the ground of husband and wife policy, the husband of the petitioner had made a request and thereafter he was on request brought on transfer to Dongergarh. Now the wife is being sent to a different place which according to the petitioner is more than 150 kilometers. This fact also needs to be verified by the respondent no.2 while considering the representation of the petitioner.

5. Till the representation of the petitioner is decided, the effect and operation of the impugned order so far as the petitioner is concerned shall remain stayed
