This is the second application under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the applicant, who is apprehending his arrest in connection with Crime No.244/2008, registered at Police Station Kotwali Mahasamund for the offence under Sections 407, 120B of IPC and Sections 3, 7 of the Essential Commodities Act.

The first bail application of the applicant was dismissed, as withdrawn, on 5.9.2012.

Considering the facts and circumstances of the case, this Court is not inclined to extend the benefit of Section 438 of Cr.PC to the applicant. 5.
