The appeal has been preferred challenging the correctness of the verdict dated 12.07.2018 passed by the learned Single Judge in WPS No. 6181 of 2010. The appeal is belated by 366 days which is sought to be condoned by filing a separate application.

When the matter is taken up for consideration, the learned counsel appearing for the parties from both the sides submit that exactly similar matter has been

considered by this Court arising out of the common judgment and that interference has been declined. A copy of the verdict passed by this Court on 29.08.2019 in W.A. No. 389 of 2019 arising from WPS No. 4800 of 2010 (which was also disposed off by the learned Single Judge as per the common judgment) is placed for perusal of this Court. As per the said judgment, it was held that there was no merit in I.A. seeking to condone the delay and also with regard to the appeal as well.

In the said circumstances, both the I.A. and the appeal stand dismissed in terms of the judgment as aforesaid.
