The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.53/2016 registered in Police Station Fingeshwar, District Gariyaband (C.G.) for offence punishable under sections 363, 366, 376 of Indian Penal Code & Section 3, 4 of Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case, a report was made by mother of the prosecutrix on 15/05/2016 that her daughter is missing. Subsequently, when the girl came back on 17/05/2016, on enquiry it revealed that the applicant enticed her on the pretext of marriage and committed sexual intercourse. Thereby, offence is committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and no allegation is attributed in the statement of the girl when it was recorded on 17/05/2016 and subsequent statement was recorded wherein false allegations were attributed. Therefore, learned counsel submits that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Considering the statement at this stage, this court is not inclined to release the applicant on bail.
