Hon'ble Shri Justice Rajendra Chandra Singh Samant Order on Board 13-09-2019
1. Heard on I.A. No.01/2019, an application for grant of temporary bail.
2. However, the learned counsel for the State submits that the case diary is available, therefore, the matter is heard finally.
3. This is the First application for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 340/2019, registered at Police Station- Kharsiya, District- Raigarh (C.G.) for the offence punishable under Sections 354,354(A), 354(C) I.P.C.
4. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and he is in jail since 19.08.2019. The applicant is a physiotherapist and he used to give treatment to the victim in this case. When the applicant demanded the fees for his services, the victim raised a dispute and then has lodged this false F.I.R. against this applicant. Hence, it is prayed that he may be granted bail.
5. Learned counsel for the State opposes the application.
-26. Heard learned counsel for the parties and perused the case diary.
7. According to the prosecution case, the applicant has been giving the victim physiotherapy since one month prior to the date of the incident. On 14.08.2019, victim was alone at her home, finding this opportunity, the applicant, by using physical force, outraged her modesty.
