The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.64/2016 registered in Police Station Darri, District-Korba (C.G.) for offence punishable under sections 457, 380 of IPC.

As per the prosecution case, on 12/06/2016, the applicant alongwith other co-accused has committed theft in the wine shop at Darri worth Rs.35,000/ and on the basis of CCTV footage, the applicant has been apprehended.

Learned counsel for the applicant submits that similarly placed co-accused persons have been enlarged on bail by this court in M.Cr.C. No.4686/2016 on 19/08/2016 and in M.Cr.C. No.5747/2016 on 26/09/2016, therefore applicant may also be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail, however he is not able to dispute the fact that similarly placed co-accused persons have been enlarged on bail by this court in M.Cr.C. No.4686/2016 on 19/08/2016 and in M.Cr.C. No.5747/2016 on 26/09/2016.

Considering the facts and circumstances of the case and also for the fact that similarly placed co-accused persons have been enlarged on bail by this court in M.Cr.C. No.4686/2016 on 19/08/2016 and in M.Cr.C. No.5747/2016 on 26/09/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
