The applicant has preferred this bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.250/2019 registered at Police Chowki Manikpur, Police Station Kotwali Korba (CG), for the offence punishable under Sections 302, 397 & 34 of the Indian Penal Code.

Applicant and co-accused Jeetu Tandon have allegedly committed murder of Pradeep Kumar (since deceased) on 30-4-2019.

The motorcycle used at the time of incident and other articles have been recovered from this applicant.

Learned counsel for the State, per contra, would oppose the bail application. Learned State counsel informs that as per information available in the case diary, the applicant is a habitual offender having 11 previous cases against him involving commission of theft, lurking house trespass, loot, etc.

Considering the entire facts situation of the case and particularly considering the material available on record, I am of the opinion that present is not a fit case to release the applicant on regular bail.
