Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 12/11/18 1.
Learned counsel for the petitioner submits that in accordance with the direction given by this Court by order dated 20.09.2017 though the order has been passed by respondent No. 2 on 20.04.2018 (AnnexureP/1) but he has not been given opportunity of hearing before passing that order, therefore, the impugned order is unsustainable and bad in law. 2.
I have heard learned counsel for the petitioner and perused the impugned order.
3.
In the impugned order, in the third paragraph, it has clearly been recorded that the complainant Jagdish Soni has been heard. If the said fact recorded in the order sheet is incorrect, the petitioner is to approach the said authority bringing to their notice that he has not been heard and impugned order has been passed and in that event, the said authority would consider it and do the needful in accordance with law. 4.
With the aforesaid observation, the writ petition stands disposed of. No order as to cost(s).
