The present is an application filed under Section 439 of CrPC seeking for grant of bail to the Applicant who is in jail since 30.12.2016 in connection with Crime No.828/2016 registered at Police Station- Civil Line, Raipur, District Raipur, for the offence punishable under Sections 193, 420, 467, 468, 34 of IPC.

As per the prosecution case, the Applicant in connivance with the other co-accused person is said to have been standing as a surety with false, fake and fabricated Rin Pustika in the lower Courts. 3.
Learned Counsel for the Applicant submits that the Applicant was not involved in the instant case and that the person who had stood as a surety was the co-accused Ramu and therefore the Applicant who has already remained in jail for a period of about 11 months may be released on bail.

Learned Counsel for the State however opposing the bail application submits that the Applicant is the person who had called the co-accused Ramu to stand as a surety in a criminal case for an accused person and therefore he is also equally involved in the instant case.

Having heard the contentions put forth on either side and on perusal of record and taking into account the period of custody already undergone by the Applicant and the nature of role played by him, this Court is of the opinion that prima facie a strong case is made out for grant of bail to the Applicant.

Accordingly, the application for grant of bail is allowed. It is ordered that the Applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety of the like sum to the satisfaction of the concerned Trial Court for his appearance as and when directed.
