Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 13/01/2021

1. This is the second bail application preferred by the applicant under Section 439 of Cr.P.C. for grant of bail, as he is arrested in connection with Crime No.58/2020, registered at Police Station - Berla, District- Bemetara (C.G.) for the offence punishable under Sections 376 (2) (i) (n) of the Indian Penal Code and Section 5 (I), 6 of Protection of Children from Sexual Offences Act.

2. The first bail application was dismissed with liberty to revive the prayer after examination of the prosecutrix. Now, the prosecutrix has been examined before the trial Court.

3. Having seen the deposition and the material available in the case diary, I am not inclined to take any different view of the matter.
