The applicant has filed this First bail application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody since 20.07.2018 in connection with Crime No.32/2018 registered at Police Station : Mahila Thana, Raipur, District - Raipur (C.G.) for the offence punishable under Sections 498A, 323, 506 and 34 of the IPC.

As per the prosecution case, the complainant lodged a report at Mahila Thana, Raipur, alleging in it that the applicant and her other in-laws in the family subjected her to cruelty on account of demand of dowry and also threatened her for dire consequnces if she will give not give birth to a baby boy. On the basis of said report, the offence was registered against the applicant and he has been arrested on 20.07.2018.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the crime in question as there is no demand of dowry made by the applicant. He further submits that the applicant is in custody since 20.07.2018, charge-sheet has been filed and trial will take some more time, therefore, he may be released on bail.

On the other hand, State counsel opposes the bail application.

I have heard learned counsel for the parties and perused the record.

Considering the totality of the facts and circumstances of the case, the nature of allegation and the fact that the applicant is in custody since 20.07.2018, charge-sheet has already been filed and the matter is pending before the Judicial Magistrate First Class, this Court is of the opinion that it is a fit case to release the applicant on bail.

Accordingly, the application is allowed.

It is directed that the applicant shall be released on bail on his executing a personal bond for a sum of Rs. 20,000/- with one surety for the like amount to the satisfaction of the Trial Court for his appearance before the Trial Court as and when directed.
