1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 29-11-2020 in connection with Crime No. 303 of 2020 registered in Police Station- Kanker, District North Bastar, Kanker (CG) for the offence punishable under Sections 376 and 506 of IPC.

2. Learned counsel for the applicant seeks permission of this court to withdraw the bail application with liberty to file an application before the trial Court.

3. Permission is granted.

4. Accordingly, the instant bail application is dismissed as withdrawn with the aforesaid liberty.
