It is submitted by the learned counsel for the petitioner that the petitioner is in possession of the land Kh. 227/6, measuring 0.01 acres since about 30 years, which is situated under the Gram Panchayat Limo, District - Kawardha. The petitioner was granted no objection certificate by the Gram Panchayat for construction of Sulabh Sauchalaya. The petitioner was also granted lease of the same land by the Naib Tahsildar, Kawardha. The petitioner has filed a representation, before

the respondent No.4 and prayer is made to issue certificate of title/ownership of the land in possession of the petitioner, which has not been decided so far. Hence, this petition.

Learned State counsel appearing on behalf of the respondents No.1, 2, 3 & 4 opposes the petition and the submissions made in this respect. However, it is submitted that this petition may be disposed off with direction.

After considering on the submissions and perusing the documents filed along with the petition, this Court is of the view that this petition can be disposed off at motion stage. Accordingly, this petition is disposed off at motion stage. The petitioner is granted liberty to file representation making a prayer for issuance of certificate of title/ownership of the land in his possession within a period of 15 days from today. The respondent No.4 is further directed to consider on the representation filed by the petitioner and take decision on the same in accordance with the law preferably within a period of 60 days from the date, the representation is filed.
