Virendra Kumar Meshram, S/o Ram Lal Meshram, Aged about 50 years, R/o 33, Lal Bangla, Budhwaripara, Ward No. 12, P.O. & Tahsil - Dongargarh, Distt. Rajnandgaon(C.G.) [Petitioner in contempt case] ---- Non-applicant For Applicant : Shri P.R. Patankar, Advocate. For Non-applicant : Shri K.N. Nande, Advocate. Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 30/11/2018 1.
This M.C.C. has been filed for recalling / modification of the order dated 06.08.2018 passed in Cont. No. 781/2018.
2.
Non-applicant No.1 herein has filed Writ Petition (C) No. 2630 of 2017 (Virendra Kumar Meshram & others Vs. State Bank of India & others), in which, this Court has granted interim relief by order dated 26.09.2017. Later on, that writ petition was disposed
of on 13.10.2017 as the State Bank of India as withdrawn the Circular dated 5.9.2017. Thereafter, Mohd. Arif Menon filed Writ Petition (C) No. 330 of 2018, in which on 7.2.2018, this Court has issued notices to the respondents, which is pending consideration. 3.
Meanwhile, the non-applicant herein filed Contempt Petition (Civil) No. 781 / 2018, in which, this Court directed the respondents - Bank to comply with the order dated 26.09.2017 passed in Writ Petition (C) No. 2630 of 2017. 4.
I have heard learned counsel appearing for the parties. 5.
It is well settled that once a final order is passed, all the earlier interim orders merge into the final order, and the interim orders cease to exist. {See : Prem Chandra Agarwal and another Vs. Uttar Pradesh Financial Corporation and others1} 6.
In that view of the matter, as the final order has already been passed in Writ Petition (C) No. 2630 of 2017 on 13.10.2017, interim order dated 26.09.2017 passed in W.P. (C) No.2630 of 2017 has already merged into final order, therefore, order dated 06.08.2018 passed in Cont. No. 781 of 2018 is hereby recalled. 7.
Consequently, the M.C.C. stands disposed of.
