1. The challenge in the present writ petition is to the order Annexure P/1 dated 13.08.2019 whereby the petitioner has been transferred from Tahsil Office Dhamdha, District Durg to Tahsil Office Narayanpur, District Narayanpur.

2. The contention of the petitioner is that the petitioner is a class-III cadre employee, which is district cadre post and if the petitioner is transferred out of district his seniority would get adversely affect. The further contention of the petitioner is that the petitioner is aged more than 57 years and as per the transfer policy of the State Government persons over 55 years should not be transferred to a scheduled area as far as possible and the present place of transfer is a core scheduled area.

3. Considering the aforesaid facts and circumstances of the case, let the petitioner make a detailed representation to the respondents within a period of 10 days from the date of receipt of the copy of this order and the respondents in turn shall consider and decide the same within a further period of 45 days from the date of receipt of the representation. Till the representation of the petitioner is decided, the effect and operation of the impugned order shall remain stayed.

4. With the aforesaid observations, the present writ petition stands disposed off.
