1. Learned counsel for the petitioner submits that the petitioner stood retired on 31.03.2021 which was intimated way back on 07.12.2020 by respondent No.

2. She submits that thereafter the retiral dues of the petitioner has not been cleared till date. It is further submitted that the petitioner has made several representations to the Managing Director, C.G. State Civil Supplies Corporation Limited but till date no amount has been released which in turn

has resulted into question of survival of petitioner.

2. Learned counsel for the respondent opposes the argument.

3. Perused the documents and heard learned counsel for the parties.

4. Having gone through Annexure P-1, it is not in dispute that petitioner stood retired on 31.03.2021 which was intimated on 07.12.2020. The tenor of letter would reflect that everything was in knowledge of the respondent No. 2 that the petitioner is going to retire on 31.03.2021. Considering the time passed, till date if the retiral dues of the retired person is not released, it would result into hardship and the question of survival may come to fore. Under the circumstances, the respondents are directed to release the retiral dues and pensionary benefits of the petitioner within a period of 45 days from the date of receipt of a copy of this order. In absence, thereafter the retiral dues shall further carry interest @ 9 % p.a. from the date of his retirement i.e. 31.03.2021 and in such case if there is casual approach in releasing the amount and unnecessary time is consumed, the amount of interest shall not be burdened on the public exchequer and would be recovered from the erring officer.
