Agrawal Order On Board 20/09/18 Learned counsel for the petitioner submits that by the impugned order dated 14.08.2018 (Annexure - P/1), the petitioner's application under Order 39 Rule 3 of CPC has been rejected by the District Court and the case was fixed on 12.09.2018 for hearing on application under Order 39 Rule 1 and 2 of CPC but now it has been adjourned which may be directed to be dispose of expeditiously as the application is pending consideration. 2.

I have heard learned counsel for the petitioner. 3.

Be that as it may, the District Judge, Durg is directed to consider and dispose of the application filed by the petitioner under Order 39 Rule 1 and 2 of CPC expeditiously, preferably within a period of one week from the

date of receipt of copy of this order after hearing the affected parties and concerning the urgency shown by the learned counsel for the petitioner. 4.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
