The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.82/2016 registered in Police Station Nandghat, Bemetara (C.G.) for offence punishable under sections 409, 420, 467, 468, 471 and 34 of the Indian Penal Code, 1860 and 66 (B) of the I.T. Act, 2000.

As per the prosecution case, a report was made by Branch Manager of State Bank of India, Temri Branch against the applicant who was earlier Branch Manager that certain amount for crop insurance, which came to the Branch, the applicant transferred it to the different account holder and thereafter withdrew the same on the basis of withdrawal form signed by the account holder and benefitted himself to the extent of Rs.18,59,741/-.

Learned counsel for the applicant submits that other co-accused has been enlarged on bail in M.Cr.C.No.4041/2016 on 27/07/2016, charge sheet has been filed and the applicant is in jail since 10/03/2016, no

further investigation is necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Considering the facts and circumstances of the case, charge sheet has been filed, no further investigation would be necessary, the evidence appears to be documentary in nature. Therefore, considering the facts, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
