Taking into consideration the submission of learned counsel for the State that the prosecutrix have remained firm right from the beginning regarding criminal overt act for removing clothes which fact stated in the prompt FIR filed within 3 hours and tenderness reported by the doctor, we are inclined to grant leave to appeal by condoning delay in filing appeal. The application is accordingly allowed. 2.

The appeal filed by the State be registered as an acquittal appeal and be listed for further orders.
