Hon'ble Justice Shri Gautam Chourdiya Order on Board 28/01/2021 1) The applicant/complainant has filed this application under Section 439(2) of Code of Criminal Procedure, 1973 for setting aside the order dated 03/12/2020 passed by 2nd Additional Sessions Judge, Durg in Bail Application No. 1674/2020 granting anticipatory bail to non-applicant No. 1 Smt. Sunita Singh in connection with Crime No. 845/2020 registered at Outpost Padmanabhpur, Police Station Durg, District Durg (C.G.) for the offence punishable under Section 420 of the Indian Penal Code. 2) Learned counsel for the applicant seeks to withdraw this application with liberty to file afresh as and when occasion arises. Further he prays for return of certified copy of the impugned order.

3) Accordingly, the application is dismissed of as withdrawn with the liberty as stated above.

4) Registry is directed to return certified copy of the impugned order to the Counsel for the applicant on his furnishing true authenticated xerox of the same.
