Sam Koshy Order On Board 01/10/2018 The petitioner on an earlier round had filed a writ petition i.e. WPS No. 5587/2011 for the same relief which got dismissed on 29.02.2016 as having become infructuous on the submission made by the counsel for the petitioner.

Given the said fact, this Court is of the view that the second subsequent petition for the same cause of action may not be sustainable and it would be left open for the petitioner to avail appropriate remedy for getting the said writ petition restored by moving an appropriate application. 3.
