Heard on Cr.M.P. followed by acquittal appeal preferred against the judgment dated 09.09.2021 passed by the Judicial Magistrate First Class, Sakti, District-Janjgir-Champa (C.G.) in Criminal Case No. 668/2018 whereby and whereunder learned trial Court acquitted the accused for charges framed under Section 138 of the Negotiable Instrument Act. The Cr.M.P. is within limitation. On due consideration, this Court is of the view that special leave to appeal may be granted. Consequently, the present Cr.M.P. is allowed. Registry is directed to list the matter under the head of acquittal appeal.

On appellants paying process fee within 10 days, notice along with a copy of acquittal appeal be issued to the respondent through registered and usual mode, returnable within 4 weeks. List the matter for further hearing after service to respondent is complete and record is available.
