(2) This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested on 26.10.2019 in connection with Crime No.172/2019, registered at Police Station Bodla, Civil and Revenue District Kabirdham for the offence punishable under Section 20(B) of Narcotic Drugs and Psychotropic Substances Act. (3) Case of the prosecution, in brief, is that the police received a secret information from the informant that the applicants were transporting illegal cannabis in vehicle pickup bearing registration No.M.P.20G.B.1186 and, thereafter, the police seized cannabis quantity about 181.335 kg from the possession of the present

applicants.

(5) Counsel appearing for the applicants submits that the applicants have not committed any such offence and they have been falsely implicated in the case and therefore, the applicants may be released on bail. (6) On the other hand, counsel for the State opposes the prayer for grant of bail. (7) After hearing counsel appearing for the parties, taking into consideration the facts and circumstances of the case, nature and gravity of the offence and looking to huge quantity of ganja i.e. 181.335 kilograms, which is the commercial quantity seized from the possession of the present applicants, I am not inclined to release the applicants on bail. Thus, the bail application is rejected. (8) Certified copy as per rules.
