The instant MCC has been filed under Section 152 of the Code of Civil Procedure, 1908 for incorporation of the name of counsel in First Appeal No. 4 of 2008 as respondent No.5. 2.

As per the application, the judgment in the said appeal is delivered on 24-7-2019 wherein name of K.A. Ansari, Senior Advocate assisted by Mrs. Meera Ansari, Advocate is not mentioned. After hearing the counsel this application is liable to be rejected.

From the order sheet, name of the counsel mentioned in the application is not appearing. Section 152 of the CPC is made

for correction of errors arising therein from any accidental slip or omission which is clerical or arithmetical, therefore, Section 152 of the CPC has no application in the present case. Name of the counsel is shown only after perusal of the order sheet and same cannot be corrected by way of this application.

4. Accordingly, the instant MCC is liable to be and hereby dismissed.
