1. The challenge in the present writ petition is to the order of transfer dated 21.08.2019 Annexure P-1 whereby the petitioner has been transferred from Bagbahar, Block Patthalgaon, District Jashpur to Khadgawa, District Koriya.

2. The contention of the petitioner is that the petitioner, at the present

place of posting, has been working since 2013 and now he is being sent from one scheduled area to another scheduled area, therefore, the respondents should have been considered transferring him to a non-scheduled area. Further contention of the petitioner is that the wife of the petitioner also suffers from paralysis on right side and it would create great complications to the petitioner at his office level and at domestic level in case the order of transfer is complied with.

3. Given the aforesaid facts, let the petitioner make a detailed representation to the respondents within a period of 10 days from the date of receipt of certified copy of this order and the respondents in turn shall consider the same within a period of 45 days from the date of receipt of the representation. While deciding the representation, the respondents shall sympathetically consider the case of the petitioner particularly taking note of the health condition of the wife of the petitioner.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order so far as the petitioner is concerned shall remain stayed

5. With the aforesaid observation, the writ petition stands disposed of. Sd/- P. Sam Koshy Judge Khatai
