Hon'ble Shri Justice Gautam Chourdiya Judgment On Board 27/10/2021 1) This appeal is filed under Section 374(2) of Code of Criminal Procedure, 1973 against the judgment of conviction and order of sentence dated 18/07/2017 passed by Special Judge (NDPS) Surajpur, District Surajpur (C.G.) in CNR No. CGSJ010001782015; whereby the appellant stands convicted and sentenced as under:- Conviction Sentence Under Section 20(b)(ii)(B) of narcotic Psychotropic Substances Act.

R.I. for 5 years and fine of Rs. 20,000/-, in dafult of payment of fine 6 months R.I.

2) As per office note, non-bailable warrant against the appellant returned unserved and the report with the sole appellant has died on 12/03/2020. Copy of the Death Certificate as well as the certificate of the Sarpanch, Gram Panchayat, Haripur is also available on record confirming the fact that the appellant died on

12/03/2020.

3) No application has been filed by the legal heirs of the appellants for prosecuting this appeal till date.

4) In these circumstances, the present appeal stands abated and is dismissed as such.
