1. It is submitted that the petitioner is a self help group engaged in the business of supplying ready to eat meal at Sector-Chandrapur Block Dabhra. The respondent made publication of an advertisement dated 10.2.2020, on which the petitioner filed application and the petitioner/society was selected vide order dated 27.6.2020. The work order was alloted to the petitioner subsequently, however, one of the

Page No.2 contender in that process of selection filed WPC No.1929/2020 and another contender filed WPC No.1971/2020. Both these petitions were disposed off by this Court directing the petitioner in those cases to prefer appeal before the Collector. Subsequent to which respondent No.3 has issued an order dated 10.12.2020, making a mention that the selection procedure on the basis of the advertisement dated 22.7.2020 has been cancelled and any selection made on the basis of that procedure shall be deemed void.

In the present development of things, respondent No.3 has by oral instructions directed the petitioner to discontinue the work of supply of ready to eat meals and the respondents are also making preparation for publication of fresh advertisement, therefore, this petition has been filed praying for grant of relief.

3. Learned State counsel representing respondents opposes the submissions made in this respect.

5. The petition is disposed off at motion stage. The petitioner is granted liberty to file a representation before the respondent No.3 within a period of 10 days and on filing of any such representation, the respondent No.3 shall be obliged to consider on the same within a period of 30 days. It is also directed that until the representation is filed and decided within the time is mentioned hereinabove, if the publication of any advertisement regarding the work of supply of ready to eat meal is contemplated than that shall be kept in abeyance till the period of 40 days from today.
