The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.134/2016 registered in Police Station Nandini Nagar, District Durg (C.G.) for offence punishable under sections 420, 467, 468, 471, 34 of Indian Penal Code. 2.

As per the prosecution case, in response to advertisement for installation of Airtel Tower in the land, complainant Krishna Bai deposited Rs.1200/- as registration fees in the account of the applicant and also deposited Rs.25,000/- and 20,000/- in the account of other co-accused Kuldeep Kaur and Manoj. It is alleged that the applicant alongwith others hatched conspiracy and cheated for which Krishna Bai lodged a report that Rs.46,200/- total was deposited and during investigation it was found that such allurement was also extended to Mangi Bai and Rokhanlal. 3.

Learned counsel for the applicant submits that only Rs.12,00/- was deposited in the account of the applicant and if someone deposits in the account then how the applicant can be held liable, therefore no case is made out against the applicant and he may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Perused the statement of complainant Krishna Bai. Perusal of the statement reveals that on the assurance of the applicant amount was deposited in his account and also in the account of other co-accused. Similar statement is also made by Pokhanlal. Considering the way organized offence has been committed, this court is not inclined to release the applicant on bail. 6.
