The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.15/2016 registered in Police Station Rengakhar, District Kabirdham (C.G.) for offence punishable under sections 323, 452 & 354 of IPC.

As per the prosecution case, on 6/08/2016 the applicant entered into the house of the victim pressed her breast and on having resisted assaulted the victim by way of a club. Thereby, offence is committed. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, statement have already been recorded, no further evidence is required, because of the previous enmity false allegations have been attributed against the applicant, charge sheet has been filed and the applicant is in jail since 19/08/2016, therefore applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the facts and circumstances of the case, degree of allegation, charge sheet has been filed and the applicant is in jail since 19/08/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
