Hon'ble Shri Justice P. Sam Koshy Order on Board 04.09.2019

1. Challenge in the present Writ Petition is to the order dated 23.08.2019 whereby the petitioner has been transferred from Gariyaband to Lormi.

2. The contention of the petitioner is that, vide order dated 08.11.2017 the petitioner was brought at the present place on account of serious Liver and Kidney ailment that the petitioner was suffering from and in less than 1 and 1⁄2 years the petitioner has now been shifted to a different place where the petitioner would find it difficult to have prompt medical attention.

3. Given the aforesaid facts, let the petitioner make a detailed representation in this regard to the respondents within a period of 10 day from today and the respondents, in turn, shall consider and decide the same at the earliest preferably within a further period of 45 days particularly taking into consideration the health condition of the petitioner. Till the representation of the petitioner is decided, the effect and operation of the order dated 23.08.2019 shall remain stayed so far as petitioner is concerned.
