1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 72 of 2016 registered at P.S. Kusmunda, Distt. Korba (C.G) for the offence punishable under Sections 419 & 420 of IPC.

2. As per the prosecution case, a report was made by complainant Kulanjan Singh that the applicant in order to provide job different amounts were collected from the complainant. It is further alleged by the prosecution that certain amounts were also collected from Surya Bhan Singh, Ramayan Singh, Mahipal, Ratan Singh, Gyan Singh, Ku. Uma etc., and thereafter it was found that the applicant has committed fraud.

3. Learned counsel for the applicant would submit that the

applicant has been falsely implicated in this case and no evidence is on record to show that the applicant has collected the amounts, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the statements of victims Kulanjan Singh, Surya Bhan Singh, Ratan Singh and Mahipal.

6. Considering the facts and circumstances of the case and the way the offence has been committed and taking into the statements of the victims, I am not inclined to release the applicant on bail. Accordingly, this bail application is rejected.
