The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.158/2016 registered in Police Station Gandhinagar, (Ambikapur-Dehat), District Surguja (C.G.) for offence punishable under section 306 of IPC.

As per the prosecution case, on 28/04/2016 one Sheela set herself ablaze. It is alleged that the applicant who is the husband of the deceased used to treat her with cruelty and on the date of dispute over watching TV on a high sound some dispute took place and the applicant who continuously abetted the deceased to commit suicide on the date of incident quarreled with her. Consequently, because of the abetment continuously eventually she committed suicide. 3.

Learned counsel for the applicant submits that the deceased was married to the applicant in the year 2002 and out of the wedlock 2 child were also born and on trivial issue deceased committed suicide, the applicant has not abetted the deceased to commit suicide. He submits that the charge sheet has been filed, therefore the applicant may be

released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the witness Raj Kumar. Considering the facts and circumstances of the case, charge sheet has been filed, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
