1. The challenge in the present Writ Petition is to the order Annexure P/1 dated 23.08.2019 whereby the services of the petitioner has been transferred from Durg to Jagdalpur.
2. Challenge is on the ground Health ground of the petitioner. Contention of the petitioner is that recently the petitioner has been detected the disease of Cancer and his treatment is undergoing at Sanjeevani Hospital at Raipur and therefore at this juncture, while his treatment is undergoing he should not be subjected to transfer and sympathetic consideration be made to the petitioner.
3. Given the facts, let petitioner make a representation to the respondent No.1 within a period of 10 days from today and on receipt of representation of the petitioner, respondent No. 1 is expected to take a decision sympathetically within a further period of 45 days.
4. Till the representation of the petitioner is decided, the effect and operation of the impugned order shall remain stayed so far as petitioner is concerned.
