Heard the matter finally.

Learned counsel for the applicant would submit that the applicant held arrested in connection with Crime No.17/2017 on 08-04-2017 by P.S. Ranchirai District Balod, Chhattisgarh for the offence under Section 420, 467, 468, 471 of the IPC. After investigation charge sheet been filed, which is pending before the JMFC Gundardehi, District Balod as Criminal Case No.391/2017. Learned counsel for the applicant would further submit that the applicant is innocent, he has been falsely implicated. There is no any material to demonstrate that the account number was in the name of the applicant or the sim allegedly used by the applicant is in the name of the applicant. Trial may take some time. He may be enlarged on bail.

Per contra, learned counsel for the non-applicant/State would submit that the applicant is resident of Merath, U.P. and as per allegation in the the present matter, the applicant induced the complainant for a Government service and asked her to deposit Rs.13,850/-in a bank account given and as per the statement of the bank account, the applicant cheated many more
-2persons and deposited the money for the sake of service; and also two mobiles, 8 number of sim of various telecom companies, computer monitor, printer and other articles were seized from the applicant. Hence, the instant MCRC may be dismissed.

Perused the entire material.

After consideration of the entire material collected, I am not inclined to grant bail to the applicant. Consequently, the instant MCRC is hereby dismissed.
