By way of this petition, the petitioner is praying for a direction to respondent authorities to consider his application for grant of compassionate appointment owing to sudden and sad demise of his brother, namely, Yogiraj Netam.

According to the petitioner, the brother of him, namely, Yogiraj Netam was working on the post of Patwari in Patwari Halka No. 24, Village Bhitardas, Tahsil Nagari, District Dhamtari, who died in harness on 21.04.2021 on account of getting infected with the Covid-19, during treatment
in Primary Medical Hospital, Gattasilli (Nagari), District Dhamtari. It is contended further that after the death of his brother, the petitioner and his family members are facing very hardship and being dependent upon his brother, the petitioner has moved an application on 28.08.2021 (Annexure P/2) before the Collector, Dhamtari praying for his appointment on compassionate ground as his parents and widow of deceased, namely Kalendri Bai Netam have already submitted their consent letters in this regard. However, despite submission of representation / application for appointment on compassionate ground, the same has not been decided till date, and therefore, it is submitted by the counsel for the petitioner that the concerned respondent authorities be directed to decide his application very sympathetically..

In view of the aforesaid contention, this Court feels that no fruitful purpose would be served in keeping the petition pending as it can be disposed of at this stage itself. Accordingly, this petition is disposed of by directing respondent authorities to take appropriate decision on the said application/representation made on 28.08.2021 (Annexure P/2) as expeditiously as possible, preferably within a period of 3 months from the date of communication of the order of this Court. 5.
It is made clear that while disposing of the petition, I have not expressed any opinion on the merits of the case and the concerned authority shall decide the same in accordance with law. 6.
